Initiation of anti-trust proceedings by the President of the Office of Competition and Consumer Protection.

The Management Board of INTERSPORT Polska S.A. with the seat in Cholerzyn („INTERSPORT”) hereby informs that on 27 December 2013 it received notification on the initiation of anti-trust proceedings by the President of the Office of Competition and Consumer Protection ("UOKiK") on participation of Przedsiębiorstwo Produkcyjno-Handlowe FORDEX sp. z o.o. with the seat in Poznań  („FORDEX”) and INTERSPORT Polska S.A. with the seat in Cholerzyn in the agreement on wholesale of skiing equipment and accessories which assumed fixing stiff or minimal retail prices for the sale of skiing equipment and accessories under the Nordica brand by distributors, which may infringe the provisions of art. 6 section  1clause of the Act on Competition and Consumer Protection (the “Act””).

In the opinion of the President of UOKIK the information obtained by the Office indicates that in connection with the building of the relationship between FORDEX company and entrepreneurs who are part of the retail distribution network of the Nordica brand products, among the others FORDEX and INTERSPORT, the ban on agreements limiting competitiveness might have been infringed by fixing prices of skiing equipment and accessories of the Nordica brand. Pursuant to art. 106 of the Act, the President of UOKiK, in way of a decision, may impose on the entrepreneur a penalty in the amount that is not higher than 10% of the revenue gained in the financial year preceding the year in which the penalty was imposed. When making the decision on the amount of the penalty the time, degree, and circumstances of infringing the provisions of the Act are taken into consideration, including previous incidents of the infringement of the Act. Pursuant to art. 50 section 3 of the Act INTERSPORT Polska S.A. is entitled to express its opinion within the period of fourteen days from the date of receiving the notification on the initiation of anti-trust proceedings.
